Direct account debits not an automatic obligation
Gerry Gerald was cool to the condominium manager’s request.
“Our new management company has decided that monthly condo fees can no longer be paid by postdated cheques issued in advance for the year,” Gerald told us. “They now want permission and authorization to withdraw the funds directly from our bank accounts. I am uncomfortable with this system. I need to know if there is specific language in Ontario’s Condominium Act that covers this situation.”
Well, there isn’t.
Although we hear that many condominiums are headed in this direction, you are likely under no obligation to go with the flow.
“The Condominium Act only requires the owner to make his/her payments,” managing partner Gerry Miller of the Toronto law firm Gardiner, Miller, Arnold informed Action Line. “I do not know of a case that has debated this issue, but my view is that property management cannot reject payment by cheque.”
